Patient rights

Because of our concern for you as a patient, we need you to have an understanding of your rights:
  • You have the right to exercise your rights while receiving care or treatment at Community Westview Hospital without coercion, discrimination or retaliation.
  • You have the right to impartial access to treatment, regardless of race, religion, sexual orientation, ethnicity, age or handicap.
  • You have the right to participate in the development and implementation of your plan of care.
  • You or your representative (as allowed under state law) have the right to be informed of the patient’s rights in advance of furnishing or discontinuing patient care whenever possible.
  • You have the right to receive care in a safe setting.
  • You have the right to be free from all forms of abuse or harassment.
  • You have the right to be fully informed in advance of care or treatment and to actively participate in the planning of your care.
  • You have the right to consent to or refuse treatment after being adequately informed of the benefits and risks of, and alternatives to treatment.
  • You have the right to decline services by students.
  • You have the right to formulate advance directives and to have hospital staff and practitioners who provide care in the hospital comply with these directives.
  • You have the right to be fully informed of and consent to or refuse to participate in any unusual, experimental or research project without compromising your access to services.
  • You have the right to know the professional status of any person providing your care or services.
  • You have the right to know the reasons for any proposed change in the professional staff responsible for your care.
  • You have the right to personal privacy.
  • You have the right to know that all communication and records concerning your care will be treated as confidential; your permission in writing is necessary for your clinical records to be released to any persons, except as otherwise provided by law or third party payment contract.
  • You have the right to access information contained in your clinical records.
  • You have the right to know the reasons for your transfer either within or outside the facility.
  • You have the right to understand the relationship(s) of the facility to other persons or organizations participating in the provision of your care.
  • You have the right to access the cost, itemized when possible, of services rendered within a reasonable period of time.
  • You have the right to be informed of the source of the facility's reimbursement for your services and of any limitations which may be placed upon your care.
  • You have the right to be free from unnecessary use if physical or chemical restraint and/or seclusion as a means of coercion, convenience or retaliation.
  • You have the right to have a surrogate (parent, legal guardian, person with medical power of attorney) exercise to the extent permitted by law, the rights delineated on your behalf if you have been found by the physician to be medically incapable of understanding the proposed treatment, are unable to communicate wishes regarding treatment, or if you are a minor without coercion, discrimination or retaliation.
  • You have the right to have a family member or representative of your choice and to have your own physician notified promptly of your admission to the hospital.
  • You have the right (or support person where appropriate) subject to your consent, to receive visitors whom you designate including, but not limited to, spouse, a domestic partner (including a same sex domestic partner), another family member, or a friend, and you have the right to withdraw or deny such consent at any time.
  • You have the right not to be restricted, limited or otherwise denied visitation privileges on the basis of race, color, national origin, religion, sex, gender identity sexual orientation or disability.
  • You have the right to ensure that your visitors enjoy full and equal visitation privileges consistent with your preferences.
  • You have the right to be informed about pain management and to have your pain treated as effectively as possible.
  • Your family has the right of informed consent of donation of organs and tissue.
  • Additionally, you have the right to file a grievance with Community Westview Hospital by contacting the Nursing Supervisor at 317-920-7290. If your concerns are not resolved, you may also contact Indiana State Department of Health by calling 233-1235 (TDD 233-5577) at 2 North Meridian Street, Indianapolis, IN 46204.

Patient responsibilities

As a patient at Community Westview Hospital, you are expected to assume the responsibility to:
  • Provide information about past illnesses, hospitalizations, medications and other matters relating to your health.
  • Cooperate with all hospital personnel and ask questions if directions and procedures are not understood.
  • Be considerate of other patients and assist in control of noise and the number of visitors, and do not smoke any where on the Community Westview Hospital campus.
  • Provide information necessary for insurance processing; however, you have the ultimate responsibility in paying all hospital bills.
  • Be respectful of the property of other persons and the property of Community Westview Hospital.
  • Help the physician, nurses, and allied medical personnel in their efforts to return you to health by following their instructions and medical orders.
  • Abide by hospital information as stated in the Community Westview Hospital Patient Guide.
